Four men, Dr Vincent Bajinya, Charles Munyaneza, Celestin Ugirashebuja and Emmanuel Nteziryayo have won their High Court case to stop them being extradited to Rwanda to face mass murder charges.
Senior judges in the case ruled that there was a real risk they would suffer a flagrant denial of justice as defence witnesses in Rwanda were afraid to give evidence in the men’s favour and further that there was a real risk of government interference with the judiciary.
Lord Gifford QC appearing on behalf of one of the accused stated the case showed “an emerging international consensus that there is no fair trial in Rwanda”
Dr James Smith of the Aegis Trust said “If the High Court is unable to allow extradition because the legal system in other countries does not meet its high standards, then the government should revise and amend legislation to allow proceedings in this country”
The Aegis Trust launched a campaign in October 2008 to strengthen UK law on war crimes and crimes against humanity and genocide.
